The Assets Recovery Agency (ARA) has won its first contested case using its taxation powers. The agency argued that a Mr Harper of Northern Ireland had receipts from the illegal importation of cigarettes and alcohol, distribution of counterfeit goods, and others' criminal activity on which tax had not been paid.

The agency argued that a Mr Harper of Northern Ireland had receipts from the illegal importation of cigarettes and alcohol, distribution of counterfeit goods, and others' criminal activity on which tax had not been paid.
Mr Harper did not provide any supporting evidence to counter the assessments for 1995-96 to 2002-03 and the Special Commissioners confirmed that tax of £71,281 was payable. The Agency's methodology was held to be 'sound and based on a proper approach to the assessment of undeclared income'.
