In late July 2022 five years after the Taylor review of modern working practices (www.tinyurl.com/taylorrev17) recommended greater clarity on employment rights and more than four years since it conducted its consultation on employment status in 2018 the government finally published its consultation response (tinyurl.com/govempstres).

As the government has been hinting at for months it will not provide a statutory employment test which is effective for both employment legal rights and employment tax despite previously accepting that there is a lack of clarity and certainty surrounding the existing tests for employment status.

The introduction to the new consultation response states that ‘the UK has one of the best employment rights records in the world’ and that ‘maintaining a strong flexible and well-functioning labour market will be essential to building back better from the pandemic’.
