  • HMRC’s advisory fuel rates are amended quarterly and the latest ones (for September) appear in this week’s news. Make sure that clients who use the rates are aware of them.

 

  • If HMRC is resisting attempts to have a penalty for a careless error suspended take a look at recent tribunal cases such as Eastman (TC5276) where the judge has overruled HMRC to see whether similar arguments could be made for your client.

 

  • The definition of an ‘enabler’ in the Strengthening Tax Avoidance Sanctions and Deterrents discussion document is widely drawn. Practitioners might review their present activities and determine whether and to what extent they could fall within these proposals.

 

  • Old UK GAAP required lease incentives to be spread over the period to the next rent review. In contrast...
