Protection for trustees

Lesley King emphasised the importance of knowing not just the rules that govern trusts but also to ensure that the trust deed has been carefully read to ensure that those rules have not been varied in any way.

It is perfectly acceptable to appoint a beneficiary as a trustee. However Lesley warned that this can create conflicts of interest such as in Berger v Berger [2013] EWCA Civ1305.
